Ballot Measure

Supports: Anti-Corruption

Creates an automatic recall process in the Brownsville City Charter for a mayor or commissioner convicted of a crime that is not a felony and not a Class C misdemeanor. The city attorney would have to ask a Cameron County district court to decide whether the crime involved moral turpitude, meaning dishonest or immoral conduct, and if the judge says it did, the City Commission must call a recall election at the next date allowed by state law without any recall petition being gathered.

A YES vote means

A mid-level criminal conviction can trigger a court review and, if the judge finds moral turpitude, voters get a recall election on that officeholder without residents having to collect the recall signatures the charter now requires.

A NO vote means

Removing an officeholder convicted of such a crime still requires the existing certified recall petition signed by voters, and no court review is triggered automatically.
