This amendment would let Maryland's judicial-discipline panel keep a full bench when a seat goes empty. It amends Article IV of the Maryland Constitution so that when a member of the Commission on Judicial Disabilities is recused or disqualified, or a member's term expires with no replacement named, the Commission chair may recall a former member as a temporary substitute or ask the Governor to appoint a temporary substitute or extend a sitting member's term until a permanent replacement is appointed. A temporary substitute must meet the same qualifications as the member being replaced, may not be someone the Senate has rejected for the Commission, and must be a Maryland Bar member in good standing if the seat is a judge or attorney seat. A YES vote means
The Commission on Judicial Disabilities, which investigates complaints against Maryland judges, can fill a recused, disqualified or expired seat temporarily by recalling a former member or having the Governor name a substitute or extend a current member's term, so complaints can still be heard while the seat is unfilled.
A NO vote means
The Commission keeps its current membership rules, with no temporary substitutes: a recusal, disqualification or expired term leaves the seat empty until a permanent appointment is made.
